Prior to our second deployment to Kuwait, myself, Davis, Sergeant Delisle, Cpl. Harris, Jake Burgoyne, Spc. Gregory Pruitt, and Pfc. Jorge Calderon were all drinking over at Cpl. Harris’ house. We left there and proceeded to a strip club on Victory Drive. The rest of the guys all went up to the stage but myself and Sergeant Delisle stayed back in the back and played pool. One of the other guys came up and told us that we were going to watch one last girl dance and then leave. As we were headed up to the stage, I saw Davis throw change up on the stage. This enraged the dancer and she got down and walked up to Harris and threw her drink in his face. She then walked over to the DJ booth, talked to him, and went back to the stage. I guess she was still mad because seconds later she stepped down from the stage and threw her whole glass at Harris, hitting him with it. At this point we argued with the bouncers for a minute and they kicked us out. When we got outside Burgoyne gathered us all together by our vehicles and said “one of us wasn’t being truthful cause Harris didn’t throw the change, so who threw it.” (not exact quote, but close.) Davis spoke up and said he threw it and Burgoyne immediately went after him. He threw several punches at Davis but I do not believe he ever landed a clean blow. We left Davis at the parking lot and he took off walking. We then went to Denny’s and ate and headed back to Harris’ house. When we got there Harris sent his wife out to find Davis and that was the end of it. To my knowledge Davis never informed his chain of command or suggested that he was going to do so. I also don’t remember him having a black eye from the incident either. Had Davis told his chain of command they most definitely would not have made him and Burgoyne roommates when we got back.

According to these statements, it seems obvious the dancer knew who threw the change at her. She threw a drink at Harris twice in retaliation. But Harris never spoke up, never stepped up to Burgoyne and admitted that Richard was not to blame. In fact, Burgoyne asked Harris, and Harris denied any involvement. Something else stands out in this statement—by now Jacob Burgoyne was the lowest-ranking soldier among this group, having been busted down to a buck private for continual discipline problems. But by gathering these soldiers together in a circle to get to the bottom of things, he asserted himself as the leader, and the higher-ranking soldiers followed along.

As for Justin Harris, his statement about this night confirms that Burgoyne was quick to react violently to even the smallest problems:

A. Myself, Sergeant Deslile, and a few others.

Q. Did Spc. (inc) Burgoyne threaten Spc. Davis during this incident or after?
